Maintenance – the annual service
Maintenance is mandatory at least once a year for all commercial refrigeration, air conditioning, ventilation systems, and heat pumps (AStV, KAV). Depending on the system (e.g., refrigeration system, chilled water system, monosplit, multisplit, VRF, heat pump, ventilation system), different maintenance tasks must be performed. For monosplit and multisplit air conditioning systems, these include:
Inspection and cleaning of the air-cooled condenser (outdoor units)
Inspection and cleaning of wall-mounted units, cassettes, and ceiling-mounted units (indoor units)

Administrative Penalties The Workplace Ordinance (AStV) mandates an annual inspection of air conditioning and ventilation systems. Failure to comply can result in administrative penalties of up to €16,659 per violation for the personally responsible managing director or operations manager. For refrigeration systems using fluorinated refrigerants, additional penalties of up to €14,000 apply under the EU F-Gas Regulation.
Liability for Damages – Without Limits Anyone who violates maintenance obligations is liable under civil law for all resulting damages – and bears the burden of proof. Typical scenarios include Legionella from neglected humidification systems, fires caused by defective compressors, or refrigerant leaks resulting in personal injury. In cases of serious injury or death, the responsible party also faces criminal charges for negligent bodily harm or manslaughter.
Insurance Coverage Voids Business and machinery insurance policies contain clauses regarding obligations: Anyone who fails to comply with statutory maintenance obligations risks having their insurer completely refuse coverage in the event of damage.
